Who needs factory license?
Under the Factories Act, 1948 a premises is a factory if it employs 10 or more workers with power, or 20 or more without power. Operating without a valid licence risks prosecution and closure orders.
The Factories Act is being subsumed into the Occupational Safety, Health and Working Conditions Code, 2020 as rules are notified, so timely, well-documented compliance today makes the transition smoother.
Licensing sits with the state factories or industrial safety department, and processes differ between Haryana, Delhi and Uttar Pradesh.
